Welcome to MaxoRize. These General Terms and Conditions apply to your use of the website www.maxorize.com and the purchase of products from MaxoRize B.V. By placing an order or using the website, you agree to these terms.

Article 2 - Applicability

These General Terms and Conditions apply to every offer from MaxoRize and to every agreement concluded between MaxoRize and the consumer or business customer. Before the agreement is concluded, the text of these terms will be made available to you.

These terms apply to all products offered via the website, unless expressly stated otherwise. If one or more provisions in these terms are null and void or annulled, the remaining provisions shall remain in force.

 

Article 3 - The Offer and Territorial Restrictions

All offers on the website are non-binding, unless expressly stated otherwise. MaxoRize reserves the right to modify the offer and prices. Obvious mistakes or errors in the offer do not bind MaxoRize.

IMPORTANT RESTRICTION: MaxoRize does not sell to consumers or businesses located in the state of California (United States). Orders from California will not be accepted and will be automatically cancelled with a full refund.

The offer contains a complete and accurate description of the products offered, including the main characteristics, the price including all taxes, any shipping costs, the manner in which the agreement is concluded, and the available payment methods.

 

Article 4 - Product Information

The products offered by MaxoRize are wellness devices intended for general well-being, relaxation, muscle conditioning, and fitness recovery. The products are expressly not medical devices and are not intended for the diagnosis, treatment, cure, or prevention of any disease or medical condition.

For electronic wellness devices, including the MaxoRize® Professional X, the product must not be used by or on individuals under 15 years of age. Specific safety instructions, contraindications, and age restrictions are detailed in the accompanying User Manual, which forms an integral part of these Terms & Conditions.

The product descriptions on the website have been compiled to the best of our ability. However, MaxoRize does not guarantee that all information is complete, correct, and current at all times. Images are indicative and may differ from the delivered product. Technical specifications may be changed without prior notice.

 

Article 5 - The Agreement

The agreement is concluded at the moment you accept the offer and meet the conditions set. This is done by completing the order procedure on the website and receiving an order confirmation from MaxoRize.

MaxoRize confirms receipt of your order by email. As long as receipt of the offer has not been confirmed, you may cancel the agreement. As a consumer, you have the right to a cooling-off period of 30 days after receiving the product.

 

Article 6 - Payments

Payment must be made according to the payment methods stated on the website. MaxoRize does not accept cash payments. In case of late payment, you will receive a payment reminder with a reasonable period to still pay.

If payment is not received within the specified period, MaxoRize is entitled to dissolve the agreement without judicial intervention and without being liable for any compensation.

 

Article 6a - Pricing and International Variation

The final price per country is automatically adjusted based on the delivery address and displayed during checkout. MaxoRize reserves the right to differentiate prices by country or region. Temporary promotions such as cashback offers are not cumulative or combinable with other offers and are only awarded once per household, unless otherwise stated in specific promotional terms.

 

Article 7 - Delivery, Transfer of Risk, and Permitted Use of Accessories

MaxoRize ships its products from our distribution centre in Ridderkerk, the Netherlands. The final delivery time depends on the country and address of destination. For current and detailed delivery times, please refer to the Shipping and Delivery Policy on our website.

MaxoRize makes every effort to process orders as quickly as possible but is not liable for delays beyond its control.

The risk of loss or damage transfers to you as soon as the product has been delivered to you or a representative designated by you. For business customers, the risk transfers at the moment MaxoRize has handed the product to the carrier.

THIRD-PARTY ACCESSORIES DISCLAIMER: MaxoRize is not liable for damage, injury, or defects resulting from the use of accessories, parts, adapters, cables, or other third-party products in combination with MaxoRize devices. The use of non-approved accessories may void the warranty and carries risks for which you are fully responsible and liable.

 

Article 8 - Right of Withdrawal (consumers only)

As a consumer, you have the right to cancel the agreement within 30 days after receiving the product without giving any reason. This cooling-off period expires 30 days after the day on which you or a third party designated by you physically receives the product.

To exercise the right of withdrawal, you must inform MaxoRize of your decision to cancel the agreement by means of an unambiguous statement (for example, by email or letter). You may use the model withdrawal form, but this is not mandatory.

If you cancel the agreement, you will receive all payments you have made, including standard delivery costs, within 14 days. We may wait with reimbursement until we have received the product back or until you have demonstrated that you have returned the product.

 

Article 8a - Shipping Responsibility for Returns

For returns within the statutory cooling-off period or warranty, shipping costs are the responsibility of the customer, unless otherwise agreed.

Article 9 - Liability and Indemnification

MaxoRize is only liable for damage that is the direct result of an attributable failure in the performance of the agreement. MaxoRize's liability is at all times limited to the amount paid out by the liability insurance in the relevant case, increased by any excess to be borne by MaxoRize.

MaxoRize is never liable for indirect damage, consequential damage, lost profits, missed savings, or damage due to business interruption. MaxoRize products are wellness devices and not intended for medical use. MaxoRize is not liable for health complaints resulting from improper use.

You indemnify MaxoRize, its directors, employees, representatives, and suppliers against all claims, liabilities, damages, and costs (including legal costs) arising from your use of the products, your breach of these terms, or your violation of any law or rights of third parties.

 

Article 10 - Force Majeure

MaxoRize is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. Force majeure means any circumstance independent of MaxoRize's will, which prevents the fulfillment of its obligations in whole or in part.

 

Article 11 - Intellectual Property

All intellectual property rights relating to the website, products, logos, trademarks, texts, images, and software vest in MaxoRize or its licensors. It is not permitted to copy, distribute, reproduce, or publish any content from the website without prior written permission from MaxoRize.

 

Article 12 - Complaints

Complaints about the performance of the agreement must be submitted to MaxoRize via support@maxorize.com within a reasonable time, fully and clearly described. Complaints submitted to MaxoRize will be answered within 14 days from the date of receipt.

 

Article 13 - Dispute Resolution

MaxoRize strives to resolve disputes through mutual consultation. For consumers within the EU, the mandatory provisions of the law of the country where the consumer resides remain applicable.

 

Article 14 - Applicable Law and Choice of Forum

Dutch law applies to all agreements between MaxoRize and the customer. Any disputes will be submitted to the competent court in the district where MaxoRize is established, unless the consumer chooses the competent court in their place of residence within one month after the dispute arises.

 

Article 15 - Amendment of Terms

MaxoRize reserves the right to amend these General Terms and Conditions. The most current version can always be consulted on the website. In case of substantial changes, MaxoRize will inform customers accordingly. Changes do not apply to agreements already concluded.

 

 


 

 Care+

 

Article 1. Definitions

In these terms and conditions, the following definitions apply:

  1. The Service: The MaxoRize Care Plus service, being an additional service entitling the customer to a one-time replacement of the product under specific conditions.
  2. The Product: The MaxoRize® Professional X purchased simultaneously with the Service.
  3. The Customer: The natural person who has purchased the Service from MaxoRize B.V.
  4. Service Period: The period of 12 months starting from the delivery date of the Product.

 

Article 2. Scope of the Service

  1. MaxoRize Care Plus is a service contract entitling the Customer to one (1) complete replacement of the Product if the Product becomes defective or no longer functions properly due to causes specified in Article 4.
  2. The Service is strictly linked to the serial number (or purchase order) of the originally delivered Product and is not transferable without written consent from MaxoRize.
  3. The replacement concerns a new or 'as new' refurbished unit of the same model (MaxoRize® Professional X). If this model is no longer available, MaxoRize will offer an equivalent alternative.

 

Article 3. Duration and Termination

  1. The Service commences on the date the Customer physically receives the Product.
  2. The Service has a maximum duration of 12 months.
  3. The Service terminates automatically:
    • After 12 months have elapsed; or
    • At the moment a replacement product has been delivered once under this Service.
  4. There is no automatic renewal.

 

Article 4. What Is Covered by the Service? (Service Coverage)

The Customer may claim a replacement device in the following situations ("Accidental Damage"):

  1. Drop Damage: The product no longer works after a fall.
  2. Impact Damage: Physical breakage or defect caused by impact.
  3. Liquid Damage: Defects caused by water or other liquids.
  4. Technical Defect: Any unexpected technical failure that occurs, even if this would fall outside the standard manufacturer's warranty (provided it was not caused intentionally).

 

Article 5. Exclusions

No right to replacement exists in case of:

  1. Theft or Loss: If the Customer no longer possesses the product, no exchange can take place.
  2. Cosmetic Damage: Scratches, dents, or discoloration that do not affect the functioning of the Product.
  3. Intent and Misuse: Damage that was intentionally inflicted or resulted from reckless use, unauthorized modifications, or repairs by third parties.
  4. Accessories: The Service applies only to the main device, not to separate accessories (cables, attachments, etc.), unless these are the cause of the defect.

 

Article 6. Costs

  1. The cost of the Service is a one-time fee of €24.99 (incl. VAT), payable at time of purchase.
  2. For an approved replacement, no additional costs (such as 'deductible' or labor costs) will be charged.
  3. MaxoRize covers the shipping costs of the replacement product.

 

Article 7. The Replacement Process & Return Obligation

To prevent misuse and ensure sustainability, the following procedure applies:

  1. Notification: The Customer reports the defect via MaxoRize customer service (email/portal).
  2. Assessment: The Customer provides evidence upon request (e.g., a photo or video of the defect).
  3. Return Obligation: The Customer is required to return the defective Product to MaxoRize or, in specific cases, demonstrably destroy it according to MaxoRize instructions.
    Please note: As long as the defective product has not been received (or proof of destruction has been provided), the replacement product will not be shipped.
  4. Delivery: After approval of the request and receipt of the defective product, MaxoRize typically ships the replacement device within 2 business days.

 

Shipping Costs

The costs for returning the damaged device to MaxoRize are the responsibility of the Customer. MaxoRize covers the costs for shipping the replacement device to the Customer.

 

Article 8. Right of Withdrawal

  1. The Customer has the right to cancel the purchase of the Service free of charge within 14 days of purchase, provided the replacement service has not yet been used. The purchase amount (€24.99) will then be fully refunded.

 

Article 9. Relationship to Warranty

  1. This Service is supplementary to the consumer's statutory rights. Statutory warranty (non-conformity) remains fully in effect. Customers are not required to purchase this Service to exercise their statutory warranty rights in case of manufacturing defects.

 

Article 10. Relationship to Other Promotions

  1. This Service cannot be combined with any other promotional campaign or offer from MaxoRize, unless explicitly stated otherwise. The purchase and execution of the Care+ Service is separate from other promotions such as cashback offers and applies exclusively to defect replacement under the circumstances described in these terms and conditions.
